Is NYSED Hiding UFT/DOE Teacher Evaluation Proposals

Today is the first official day of the 2013-2014 school year for students and therefore the beginning of this dreaded evaluation system. I hear teachers are already crying. Get your artifacts ready fellow educators. Just kidding… I don’t even know what artifacts are as I have been denied professional development by my employer including Danielson. Trust me I’ve asked, but it’s been over 570 days since my last PD.

In any case, this evaluation system seemed fishy from the beginning and I mean 2010 beginning when UFT, NYSUT and NYSED were in Albany to change the law and set us up to get the Race to the Top funds. Watch this video I spent hours cutting and editing (maybe while in teacher exile).

Now it’s over 3 years later and I say “not so fast UFT, Mayor Bloomberg. Governor Cuomo, Dr. King and DOE!” You think we all fell for that January 17, 2013 11th hour agreement killed by a sunset clause skit I know I didn’t. You should have seen how many chapter leaders and delegates showed up to 52 Broadway to vote it down that day. They knew that was going to happen, so they went with Plan B aka “Let’s make believe we don’t agree, blame each other and then have Governor Cuomo have Commissioner John King impose it so we don’t need anyone’s vote.” Fine…it worked, but since then the UFT and DOE refused to show in detail what they were proposing so we can compare.

Then came May 8, 2013. On or about May 8th both the DOE and UFT were supposed to send their final proposals to New York State Education Commissioner John King. He then mandated what was to become today’s test driven, Danielson driven Teacher Evaluation system on June 1, 2013.

Now follow closely as this goes from just smelling fishy to smelling like 5 barrels of chum sitting out in the summer sun for three weeks.

Here I am sitting in teacher exile on May 22, 2013 when I get the brilliant idea to request the proposals using the Freedom of Information Law. Read the threads below as I still await a response from both NYSED FOIL office and Commissioner John King’s office. SPOILER ALERT: They don’t respond and yes I confirmed they received them. It’s over 100 days later.

Dear Commissioner King,
On May 22, 2013 I made a simple FOIL request to see the teacher evaluation proposals submitted by the NYC Department of Education and the United Federation of Teachers. Not only did I not receive acknowledgment in a timely fashion, but the NYSED FOIL office has ceased all communication with me. The Freedom of Information Law has been violated. We are taking this as a constructive denial. I’m following protocol and I am appealing to you. Please grant this appeal and have the NYSED FOIL office furnish the teacher evaluation proposals submitted by both parties.

This will confirm that an applicant has authority to appeal when an agency fails to comply with time limits set forth in the law. You stated it was an oversight that caused your office not to acknowledge my FOIL request within the 5 day limit. May I ask what is causing the non response to the original request within the 30 day limit We are post the date of 7/8/13 and no response.

Any thoughts on why they are keeping these from us What will they show when the two proposals and the actual are compared side by side

Maybe I’m wrong and I hope I am, but a simple request should have gone like this:

NYSED FOIL: Ring, Ring “Hello commissioner’s office. We have a FOIL request for the evaluation proposals sent in by UFT and DOE. Could you send them over to us Thanks.”

Commissioner’s Office: “Sure, no problem. We’ll scan them into PDF files and email them right away.”

…and then they email them to me. Is that so hard No redaction needed.
